Impact Fee Assessments

Note: All Impact Fees should be paid at 1 Courthouse Square, Suite 1400, in the County Administration Building.

Osceola County has four (4) growth related impact fee assessments. Impact fee assessments are implemented as part of Building Permit activity associated with residential, and or non-residential (commercial / industrial) building development. Impact fee assessments in effect within unincorporated Osceola County are collected for the following facility improvments: Transportation; Education; Parks & Recreation, and Fire Rescue.

Residential building development is assessed for all four referenced impact fees. Commercial and industrial building developments are assessed only Transportation and Fire Rescue impact fees. Generally, impact fee calculation is determined based on the use of a building, and or use of property. In terms of commercial and industrial building development, impact fee calculations must also consider the size of a building. Impact fee assessment rates established for Education, Fire Rescue and Parks & Recreation is applicable County wide. However, Transportation Impact Fee assessment rates differ from other impact fee assessments rates, in that, Transportation Impact Fee assessment rates are established for geographic described areas referred to as Road Construction Districts (Districts). As provided for according to Osceola County Ordinance 06-38, the County has established seven (7) Road Construction Districts, and in addition, an "overlay district" referred to as the Poinciana Concurrency Exemption District (Poinciana Overlay). Ordinance 06-38 establishes the following Districts: District 1, District 1 Shared, District 2, District 3, Poinciana Overlay, District 4, District 5 and District 6.

As established in Ordinance 06-38:

  • Road Construction District 1 and District 1 Shared support capacity improvements needed in Osceola County's portion of the State Highway System.
  • Road Construction Districts' 2-6 fund arterial and collector road construction improvements within geographically described Districts.
  • In addition, representing an "overlay district", the Poinciana Concurrency Exemption District supports road construction improvements within the Poinciana Planned Development.

The Combined Residential Impact Fee Rate Table described above lists all applicable residential impact fee rates, including residential rates in effect within the Poinciana Concurrency District. Non-residential rate determination, however, requires combining rates listed in each of the other rate tables listed above. In the event you do not find a building use or property use listed in the referenced tables, please contact Impact Fee Office staff for additional information.

Service Assessments

Osceola County imposes annual special assessments for fire rescue services and solid waste collection services within unincorporated Osceola County. Residential dwelling unit owners are assessed annually for both solid waste and fire rescue services. Commercial and industrial building owners are not assessed for solid waste collection services; however, commercial and industrial building owners are assessed annually for fire rescue services.

In development of new buildings, upon completion of a new building, on the date of issuance of the Certificate of Occupancy, the County must assess and collects a monthly pro-ration of the applicable Special Assessments described above. Following the pro-rated initial collection, annual fire rescue and solid waste service assessments are collect in accordance with the Uniform Assessment Collection Act.
