REQUEST FOR RELEASE OF FUNDS

On or about September 1, 2025 the Osceola County Board of Commissioners will submit a request to the Florida Department of Commerce (Commerce) for the release of Community Development Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project to Rehabilitate and Modernize portions of the Buenaventura Lakes Stormwater System.
The Osceola County Board of Commissioners has determined that the activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from the National Environmental Policy Act of 1969 (NEPA) requirements. Additional project information is contained in the Environmental Review Record (ERR) on file at 1 Courthouse Square, Suite 1100, Kissimmee, Fl 34742.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the Environmental Review Record (ERR) to Susan Gosselin at Susan.gosselin@osceola.org. Additional project information is contained in the ERR on file at 1 Courthouse Square, Suite 1100, Kissimmee, Fl 34742 and may be examined or copied weekdays __9_A.M to _5__P.M. All comments must be received by August 28, 2025. Comments will be considered prior to the Osceola County Board of Commissioners requesting a release of funds.

RELEASE OF FUNDS

The Osceola County Board of Commissioners certifies to the Florida Department of Economic Opportunity and HUD that Don Fisher in his/her capacity as County Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Osceola County Board of Commissioners to use the CDBG funds.

OBJECTIONS TO RELEASE OF FUNDS

Florida Department of Commerce will accept objections to its release of fund and the Osceola County Board of Commissioners certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Osceola County Board of Commissioners (b) the Osceola County Board of Commissioners has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400 107 East Madison Street, Tallahassee, FL 32399-6508. Potential objectors should contact the Osceola County Board of Commissioners verify the actual last day of the objection period.
